Tips on how to fairly evaluate a job applicant can be used in other states
New York Correction Law Article 23-A prohibits an employer from unfairly discriminating against a person previously convicted of one or more criminal offenses. So says an introduction to the Doe Fund’s Guide for New York State Employers. But just how does an employer comply with the law? How does an employer evaluate an applicant with a criminal history? What about negligent hiring claims?

The Guide for New York State Employers answers these questions in a simple, easy to understand manner by:

  • Explaining the law and providing guidance to employers on how to apply Article 23-A when making hiring decisions

  • Explaining how companies can better protect their businesses from negligent hiring claims

  • Explaining how companies can take advantage of federal and state incentive programs that are available to companies that hire applicants with prior convictions

  • Informing employers of available resources that support businesses hiring qualified job seekers with prior convictions

The guide also includes a list of non-profit organizations that will help New York employers who hire those with a criminal history. Those outside of the New York area can access the National H.I.R.E. Network which offers a state-by-state guide to resources (www.hirenetwork.org/).
